Our Terms & Conditions

All products produced by Fairy cakes for all events are subject to the following Terms & Conditions.

​

BOOKINGS & QUOTATIONS

  • All quotations are valid for 60 days from the date of issue.

  • Here at Fairy cakes for all events we prefer at least a 2 weeks’ notice for bookings.

  • We will however endeavour, where availability permits, accept short notice bookings.

  • Until a deposit is paid the desired date will not be booked and Fairy cakes for all events will not be taking the honour of the quote if the date is being booked out by another customer.

  • Fairy cakes for all events is not registered for GST and all quoted prices will be GST exclusive.

BOOKING FEE & BALANCE

  • Fairy cakes for all events charges a booking fee at the time of confirm a booking. The booking fee will be 50% of Full cost of the product that has been agreed in written.  Please note that booking fee is NON-REFUNDABLE.

  • Booking fee will be inclusive in full payment.

  • Balance of full payment is due by 14 to 7 days prior to pick up/ delivery.

  • Cake orders placed with less than two weeks’ notice require payment in full at the time of ordering. Booking fee (50%) is non-refundable.

  • All payment will be accepted via Bank transfer only

UNFORSEEN CIRCUMSTANCES

  • Where Fairy cakes for all events cancels the booking due to illness or any other unforeseen circumstance that affects the ability to deliver the ordered product, the booking fee will be refunded within 7 days of notification to the customer.

  • The booking fee will be refunded via bank transfer only, and customer needs to provide relevant details to Fairy cakes for all events to proceed with transaction.

CHANGES

  • Any changes made to your order within 14 days of collection or delivery will incur a surcharge, depending on the change requested. In most cases we can accommodate changes, however at times it is not possible. We will however endeavour to accommodate you to the best of our ability.

  • Date Changes must be submitted in writing and the new date is subject to our availability.

CUSTOMER GOODS

  • Any items supplied for your cake, must be clearly marked with your name.

  • Any items that goes on cake (touching the cake) has to be brand new (eg. Toys etc) and packaged.

  • Any items which do not meet hygiene and safety requirement will be not be used by Fairy cakes for all events.

FOOD PRODUCTS 

  • All cakes, fillings and icings may contain, or come into contact with, soy, wheat, dairy, nuts or other allergens.

  • It is the responsibility of the Customer to inform Fairy cakes for all events prior to the confirmation of their booking, of any allergy / intolerance issues.

  • It is the responsibility of the Customer to inform their guests of all allergy / intolerance information, and accordingly Fairy cakes for all events will not be held liable for any allergic reaction resulting from consumption of the cake.

  • All special dietary products are NOT guaranteed suitable for allergies, and are suitable for intolerances only.

  • All products are made to be eaten on the day of the celebration.

  • All our cakes, fillings and icing are made from scratch (except for Fondant).

  • Non edible items may be used as decorations in cakes and/or cupcakes. It is the client’s responsibility to ensure that any non edible items are removed prior to consumption.

  • All effort will be made by Fairy cakes for all events to ensure that the final product is matched to the colour chosen as much as possible however Fairy cakes for all events does not guarantee to match the exact colour/s and designs chosen.

  • All effort will be made by Fairy cakes for all events to supply the products agreed upon at the time of booking. However Fairy cakes for all events will not be held responsible if the products are not available as a result of, but not limited to, unavailability, seasonal variation or poor quality. Fairy cakes for all events reserves the rights to use its discretion to supply similar or substitute high quality product under such circumstances and will try where possible to agree this alternative product with the client prior to supply.

QUALITY

  • At Fairy cakes for all events, we pride ourselves on the quality of our products and services. It is important to remember that cakes are a perishable and delicate product. Unfortunately once we dispatch our cakes or our customers take possession of them, a number of factors relating to the care and transportation of the cakes may result in the quality being compromised or damage occurring to the cakes that are beyond our control or responsibility.

  • Care instructions must be followed thoroughly in order to avoid compromising the cakes quality and design. Unfortunately, with all the possible variables, it is difficult for Fairy cakes for all events to guarantee the cake quality in every case once it has left our premises.

PICK UP AND DELIVERY

  • Delivery will be carried out in a safe and appropriate manner. Once delivered to the customer and change of hands has been completed with the product in appropriate condition, it is then up to the customer  to store and care for the cake as per instructions provided by Fairy cakes for all events.

  • If anything is to happen to the cake after this exchange, and deemed to be fault of the Customer through not following the instructions provided, Fairy cakes for all events is not liable for any damages.

  • A delivery date,time & address will be agreed by both parties, and if the Customer is not at location at this time and date, and Fairy cakes for all events is not able to contact the Customer, the product will be transported back with Fairy cakes for all events and it will be the Customer’s responsibility to collect the product at a time that suits Fairy cakes for all events.

  • Re-delivery may incur an additional fee.

  • A pick up date and time will be agreed by both parties, and 30 minutes window will be assigned for pick ups. If the Customer could not pick up the order with in the given time frame a penalty will be added.

  • Fairy cakes for all events will not be held responsible for completing setups at a ceremony or reception venue if the venue is not ready at the pre-agreed time. Under these circumstances, we will use our discretion to leave the products at the venue (if the venue is willing to complete the setup) or to return the products to our premises for you to pick up.

  • Some cakes may need to be set up on the venue. This takes time and as such attracts a set up/handling fee on top of the delivery fee.

  • Apart from wedding cakes, pick up is preferred by Fairy cakes for all events and is by appointment only. Any requests for delivery need to be discussed in advance.

  • Once your cake has been collected the client is responsible for the condition of the cake including the delivery.

  • You agree that late delivery does not constitute a failure of our agreement, and does not entitle you to cancellation or refund of an order.

  • It is the responsibility of the Customer to check the state of the product before leaving the premises.

  • Once the item has left the premises, the Customer has accepted the item as is,and is responsible to ensure that products gets to its destination safely and is stored as per instructions from Fairy cakes for all events to achieve best results for taste and quality and to avoid any damage.

THIRD PARTY PICKUP

  • If a third party will be collecting the cake on the Customer’s behalf, this party will be given all appropriate information that would have been given to the customer. Same conditions apply as if customer were to collect themselves.

 

POSTPONEMENT

  • If, for any reason the event is required to be postponed, please contact Fairy cakes for all events immediately.

  • The new date proposed will be subject to availability.

VARIATIONS FROM REFERENCE PHOTOS

  • In some cases it may be necessary to change a colour or vary a product from the picture on our site as certain cake decorating items may from time to time be unavailable.

  • Please note that where colours are concerned, the picture represented on our website/ facebook page/ Instagram may not be a true representation of the colour of the cake as quite often screen colours and resolutions are not correct and therefore your cake may appear to be different in colour from that shown.

  • Where items are provided on cakes ( figurines or handmade sugared items) they are strictly provided as decorations on a cake, if there are any breakages or faults with the items after they are removed from the cake Fairy cakes for all events will not replace, exchange or make new items.

INTERLECTUAL PROPERTY

  • Fairy cakes for all events reserves the right to use any image of a Product made by us for publication at a later date and for advertising purpose.

  • Fairy cakes for all events will endeavour to not post any photos on social media or other platforms until after your event has taken place.

  • Fairy cakes for all events will never use any image that is supplied by the Customer, without first obtaining the Customer’s permission. Ie: Children’s birthday parties, and photos of the events.

  • Fairy cakes for all events must be mentioned (@Fairycakesforfairytaleallevents) and  tagged in social media posts where images of the cake have been published. A link to  https://fairycakesforallevents.com.au must be displayed clearly along with images that have been published to a website, magazine or other.

  • All Custom Cake Designs that are made at Fairy cakes for all events remain the intellectual property of Fairy cakes for all events. Telling people that you have made a cake which you have ordered from us is a breach of our intellectual property.

  • Any photographs that have been taken of our Cakes cannot be used for commercial or public purposes without the Permission of Fairy cakes for all events.

CANCELLATIONS/REFUNDS​

  • If there is an issue with your order please note that you must refrigerate or freeze the cake immediately and return it to us on the next business day if we are to consider a refund.

  • All requests to cancel or amend an existing order must be made in writing.

  • Requests to alter quantities may attract additional costs.

  • Refunds will not be given to customers where they don’t like the taste or texture (eg. Dry etc).Taste and texture subjective and varies from individual to individual. Samples can be ordered for a fee if you are unsure about the taste of a cake. A refund will only be given where a cake is deemed not fit for consumption. Any amounts refunded will be determined on a case by case basis.

  • Refunds will not be given if cakes texture isn't right if consumed prior to it becomes to room temperature or if the cake is outdoors for longer period. 

  • In the event of unforeseen circumstances preventing all requests to cancel or amend an existing order must be made in writing

  • If cancellation of the order is required, and you have paid your full balance, the refund policy is as follows:

  1. If the cancellation is up to one (1) month in advance of your event date, you will receive a refund, less your initial booking fee and the cost of any supplies already purchased for your cake.

  2.  If the cancellation is less than seven (7) days prior to your event, there will be absolutely no refunds given.

  3. Refunds will be paid within 14 days of cancellation.

  4.  The monies, if owed, will be refunded via bank transfer only, and the Customer will need to provide these bank details to Fairy cakes for all events.

  5. Please note: Any non-refunded balance may be credited toward future purchases, at the decision of Fairy cakes for all events.

DISCLOSURE OF INFORMATION 

Fairy cakes for all events will not disclose any personal information such as your name, address, email, telephone number to any person outside of the company, unless the customer has authorised us to do so or unless required by law to disclose such information. Furthermore, under no circumstances will Fairy cakes for all events sell or receive payments or services for disclosing customer’s personal information to any partner or external company.

COVID - 19 SPECIAL CONDITIONS

  • Fairy cakes for all events has the right to change the flavours depending on the availability of the ingredients in the market. The client will be contacted regarding unavailability of the ingredients. 

  • Pick ups and drop offs are contact less only

  • Refunds not available- if you are cancelling the event with the assumption of an upcoming lockdown.

  • Cancellation during the pandemic due to direct lock-down restrictions:                                       

  1. If cancelled within 14-7 days prior to pick up/delivery date: Booking fee will be held- if Balance has been already paid, balance will be refunded. Booking fee can be used for a future booking within 6 months from the original pick up/ delivery date. If fondant figurings/ sugar flowers/ cake toppers etc. are already done by this stage, the cost of those will be charged.

  2. If cancelled within 7- 3 days prior to pick up/delivery date: Booking fee will be held- depending on the progress of cake, a percentage of balance will be paid+ the cake/s or the related products (most likely naked cakes/ fondant figurings/ sugar flowers etc).

  3. If cancelled within 3 days prior to pick up/delivery date: full payment will be held- cake will be made as agreed and please organise contactless pick up on the due date.

AGREEMENT TO TERMS & CONDITIONS 

By proceeding with a purchase you are in agreement with our terms and conditions as stated above.
